So I was unloading a truck last night at work. I was pulling the last pallet off of the truck, and had two of my stockers pushing the pallet because it weighed about 3,000lbs.

My foot slipped, got caught under the wheel of the jack, and the guys kept pushing thinking the pallet was stuck. It rolled across my foot, crushing my big toe and the one next to it.

I broke my big toe in two places, the nail was completely ripped off, and the toe next to it was broken in one place.

The upside to this is I had a really hot Dr., and got some pretty kick ass pain meds.

The downside is I am on crutches and may need to have surgery today. Going to see an Orthopedic Surgeon at 10. I bought tickets to The Players Championship for me and my brother for his birthday present, but now I may have to miss it if I need surgery.

Oh I definitely understand that pain... had the same shit happen to me too at work when one of the legs of a stage came crashing down on my toe. Shatter the nail and my bone lol... Even today my nail isn't growing correctly...

I remembered one time my buddy accidentally dropped a vacuum cleaner down a flight of stairs which landed on my foot and cracked the nail. Peeled that bad boy off myself with a pair of needle nose pliers. Didn't break my toe though.

So let me tell you about the wonderful company I work for.

I was sent a letter, 5 days after I broke my toe in two places at work. It said if I did not return to work by 5/19/11, they would consider it me not interested in continuing my employment with the company. Two weeks to the day after I got hurt at work, I was being forced to report for work.

It also said, I would be assigned to a new position in the store that did not consist of my normal duties. My normal duties are Manager on Duty. I run the entire store, and am in charge of locking up and setting the alarm at night as well as managing the 30 + people on duty. Those are the things I do on a daily basis. My new job duties included: Greeting customers, handing out flyers, and performing tasks which can be completed in a seated position. I was also told my pay would be reduced to minimum wage, $7.25 an hour, less than half of my normal pay.

I reported to work last night, and was prepared to do my new assigned tasks, and was told I was closing the store as an mod, and i would be performing my normal functions. This means I have two options:

1) Do my normal job for minimum wage.

2) Get fired.

I won't be released for return to full duty by my surgeon until July 7th. I was told I will not be compensated for the difference in my wages by workers comp until then. What this all means is I am doing my normal job, getting paid minimum wage to do so, and won't get paid what I am owed for two months.

Also, while I was "working" last night, I was having to walk all around the store, causing my toe to start bleeding again from having it not elevated like my doctor told me it should be for a month. I had to go back to the DR this morning to have stitches put back in because the other ones got ripped out last night. I called our workers comp people and told them what happened and they told me this would not be covered by workers comp because it was an unscheduled visit. I also can't take the pain medication while I'm at work because it makes me drowsy and they won't let me work on pain meds so I'm having to work in pain for 8 hours at a time.

Who thinks I have a lawsuit here?

Jesus, that is criminal. I don't know if you have a lawsuit but it may be worth talking with any friends you have in the legal industry. I hope everything gets sorted out quickly because that fucking sucks.

At work I would avoid doing any walking that isn't necessary, maybe find paper work to get done. I understand that that may make you look like a dick, but thats nothing new ;)

Pfft, don't listen to Gooderham, it's America so everyone can sue!

That must be extremely aggravating. I don't understand how they can tell you that you have to be MOD after offering the greeter position? Maybe just the act of threatening a lawsuit will get you somewhere. What a shitty situation!

Let me tell you a fun fact about steel toe boots. That steel bends, and cuts off all your toes under high enough weight.

Mythbusters proved that the force that it would take to make a steel toe boot cut off your toes is enough to cut off your toes in a regular boot anyway. So steel toe is the way to go.

Talk to a lawyer. It is best if you can talk to a lawyer that you know so that you don't have to pay for the conversation but you are getting boned pretty hard. The good thing is that most of your issues are documented so there is evidence if it goes to trial.
