That was a brutal death. I was yelling at the screen "Pick up that sword and finish him off!" then the mountain popped up like Michael Myers in Halloween and bitch slapped Oberyn, knocking out all his teeth...I knew it was over then.

When this went down that was it for me too. I didn't even like Oberyn that much but, I knew he wasn't going to live.

The Mountain is not dead yet. He survived the fight. Oberyn Martell did not. The Mountain has a long painful death by poison ahead of him.

In terms of a legal sense, Oberyn died first, and since he was Tyrion's champion it means he is guilty regardless of whether the Mountain dies or not (although it won't look good if the Mountain dies, Tywin could just get around it by saying that Oberyn cheated by using a poisoned weapon to give him an edge, because why should he worry about pissing off the Martells more at this point? Heh.)
